MPG Law wins $2.8M for clients in suit over harassment by openly gay supervisor

Two former nurses at Community Hospital of Long Beach, Judy Alexander and Johann Hellmannsberger,  each believed that they were being subjected to harassment and discrimination by an openly gay male nurse. Ms. Alexander and Mr. Hellmannsberger retained our firm to argue their case that their supervisor subjected them to a hostile work environment by flaunting his homosexuality, giving preferential treatment to homosexual males and by having a disdain for women. Our clients were fired from their positions in 2009.

In November, 2009, we filed suit at the the Los Angeles Superior Court and in August, 2016 the jury found for our clients, awarding them them $1.4 million each.

Torres v BE Aerospace

Wrongful termination of long-time employee results in $8.5 million award

Bianca Torres originally worked for the Delco Machine and Gear, Inc. from 1989 through 2001 when the company was acquired by B.E. Aerospace Inc. With B.E. Aerospace, Ms. Torres became the Quality Assurance Supervisor for the next eleven years. In 2011, her employer placed our client under the supervision of a new manager while at their Westminster facility, who terminated her from that position in 2012 after a total employment of 23 years.

Our firm was retained by Ms. Torres who claimed that she was replaced by a younger male employee that she had trained. We filed our case against B.E. Aerospace in June 2013 with verdict rendered in June, 2016 awarding Ms. Torres $75,000 in economic damages, $1,441,000 in non-economic damages, and $7,000,000 in punitive damages. The gross award totaled $8,516,000.

Rosenberg v Tenet Healthcare

Client receives $65 million in punitive damages for sexual abuse and negligence

Our client Courtney Rosenberg underwent surgery at Tarzana Hospital in 2006 to remove an ovarian system. While recovering from surgery, Ms. Rosenberg was sexually assaulted by male nursing assistant Ramon Rodas Gaspar.

In January 2007, Ms. Rosenberg filed suit against the hospital for negligence and sexual harassment. During trial, it was also discovered that Gaspar had a history of similar behavior with other patients. On November 17, 2011, the jury found against the hospital and its owner Tenet Healthcare Corporation and awarded Ms. Rosenberg $2.36 million in compensatory damages and $65 million in punitive damages. MPG Law principal Maryann Gallagher served as co-counsel.
